Payment terms:
Payment is made by the Lessee until the 20th of the current month of using the cars in the amount of 30% of the monthly rental amount, based on the invoice issued by the Lessor for prepayment.
Delivery terms:
- The Lessor undertakes to provide the Lessee with technically serviceable tank cars suitable for the transportation of petroleum products, which have the right to run on the railways of the Russian Federation and foreign countries.
- The characteristics of the Wagons (network number, year of construction, model, carrying capacity, repair company that performed the last scheduled repair with the date, numbers of wheelsets, side frames, overhead beams) are indicated in the acceptance and transfer certificates signed by the parties when transferring the wagons.
- The place of transfer (station), quantity, inventory numbers, schedule of planned types of repairs, cruising routes are agreed by the Parties.
- The Lessor guarantees that at the time of conclusion of this Agreement and for the entire period of its validity he is entitled to lease the Cars, the Cars are owned by the Lessor, the Cars are not the subject of a court dispute, have not been sold to anyone, have not been donated, and are not under arrest or otherwise prohibited.
- The return of wagons after the expiration of the lease term is carried out in accordance with the procedure established by the terms of the contract.
- Tank cars for the transportation of petroleum products are leased in technical and commercial serviceable condition,
- Prior to acceptance / transfer to lease, wagons must be prepared by the Lessor for the transportation of gasoline in accordance with GOST 1510-84 with replacement of the bottom valve seal. Confirmation of the preparation of the wagons is a properly executed act of the form VU-20 (VU-20(a)) with a note on the replacement of the bottom valve seal.
- Leased wagons must have the right to run on the railways of the Russian Federation and foreign countries without restrictions.
- The boiler volume of the leased wagons must be at least more than 85 m3;
- After the cars are leased, the Lessor is obliged to carry out the necessary registration actions for their unhindered use for their intended purpose and entering the lease sign on the Lessee in the ABD PV of the GVTS of JSC Russian Railways.
The lessor is obliged to carry out at his own expense all types of repairs of wagons for which he is obliged to have all the necessary contracts with repair organizations at the entire landfill for the use of wagons.
The lessee prepares the wagons for loading at his own expense.
