Terms of acceptance of products of JSC "Ural Steel":
Acceptance of goods by quality:
Acceptance of the Goods in terms of quality is carried out by the Buyer without the participation of a representative of the Supplier. The Supplier has the right to take part in the acceptance of the Goods in terms of quality, if he ensures the presence of his authorized representative, endowed with the appropriate powers according to the issued power of attorney, to participate in the acceptance in terms of quality at the time of unloading the Goods at the Buyer's warehouse. The obligation to clarify the date of acceptance of the Goods rests with the Supplier.
Acceptance of the Goods in terms of quality is carried out by the Buyer by sampling the Goods (on a doubled number of samples) with the obligatory involvement of an independent expert organization in accordance with GOST, TU. An act of sampling is drawn up, signed by all persons who participated in the specified sampling. An independent expert organization draws up the results of the study with an inspection certificate.
In the event of a discrepancy in the quality of the delivered Goods, the results of the quality control of the Goods, reflected in the inspection certificate of an independent expert organization, are recognized by the Parties as binding and final and are the basis for the Buyer's presentation of the requirements provided for by this Agreement and the legislation of the Russian Federation.
Expenses associated with the return of the Product that does not comply with the terms of the Agreement, transport and accompanying documents, its replacement, additional delivery and replenishment, including transportation costs and storage costs, and other costs and losses are charged to the Supplier.
When the Buyer makes a request for replacement, the Goods of inadequate quality must be replaced by forces and at the expense of the Supplier within 15 (fifteen) calendar days from the date the Buyer submits a request for replacement or at another time agreed by the Parties.
Additionally:
In the event of the delivery of a low-quality Product, the Supplier pays a fine in the amount of 20% (twenty percent) of the value of the Product, in respect of which the quality conditions have been violated.
