This RFP procedure does not constitute an offer, invitation to make offers, acceptance of an offer or invitation to bidding. This RFP is not governed by articles 447-449 of the Civil Code of the Russian Federation. This RFP is also not a public cal for tenders and is not governed by articles 1057-1061 of Part II of the Civil Code of the Russian Federation.

Thus, this RFP procedure does not impose on the Customer any civil obligations towards the Bidders or any third persons that may incur any losses as a result hereof.
The Customer shall not bear any obligations to conclude any contracts following the results of RFP, shall have the right to refuse all the received proposals (bids) for any reason or terminate the RFP at any time without notifying the Bidders, and shall not be held liable for the Bidders or third persons that may incur any losses as a result thereof.
The Customer also bears no obligations to compensate the Bidders or any other persons for any expenses or losses associated with participation in the RFP. By participaing in the RFP, the Bidder confirms having reviewed and accepted these terms.

Bidding Organizer shall have the right to hold a second stage (re-bidding) in case the results of the first stage are not satisfactory. 30% of the bidders offering the best prices at most will be admitted to re-bidding. The winning will be a proposal of the bidder that offers the best conditionsim compliance with the requirements and criteria of the bidding procedure.

Contract award criteria:
1.Compliance of the subject of purchase with the requirements stated by OOO Serebryanskiy Cement Factory in terms of quality (acording to the Requirements Specification);
2.Price;
3.Payment and delivery terms;
4. Conrtactor's operational experience and reputation;

In case the uploaded documents are signed with e-signature, it's not required to certify those with a company seal and chif executive's signature. In case e-signature is not applied, the scanned copies of uploaded documents shall bear a company seal and the signature of a chief executive.
