Обращаем внимание, что участниками в заявке на участие в закупке указываются персональные данные (далее - ПД) сотрудников, предоставление которых необходимо на этапе заключения договора. При этом участниками не предоставляются согласия на обработку ПД таких сотрудников, что служит причиной отказа в допуске к участию в закупке по причине не соответствия требованиями ФЗ от 27 июля 2006 года № 152-ФЗ «О персональных данных». Согласно требованиям документации о закупке для подтверждения прохождения сотрудниками участника обучения (согласно требованиям «Анкеты участника о соответствии ОТПБиЭ») ПД таких сотрудников предоставлять не требуется. В этом случае необходимо предоставить реквизиты документа, подтверждающего прохождение сотрудником участника обучения в области охраны труда, промышленной и пожарной безопасности, а сами документы (в том числе согласие на обработку ПД) необходимо предоставить при заключении договора победителю закупки.
