This request for commercial proposals is not an invitation to participate in bidding procedure or public tender within the meaning of Articles 447-449, 1057-1061 of the Civil Code. The buyer is a commercial organization that is not subject to the Federal Laws No. 44-FZ "On the Contract System of the Federal and Municipal Procurement of Goods, Works and Services"and No. 223-FZ "On procurements of goods, works and services by certain kinds of legal entities". All actions on the request and receipt of commercial proposals before signing the agreement shall be considered as pre-contractual work and do not impose on the buyer any obligations for the selection of the winner of procedure and he is entitled to complete it, rejecting all proposals. Application form is an offer of the participant. This means that the participant of the request for proposals will be required to enter into a agreement with the buyer on the terms specified in its application, if the offer is accepted by the buyer. Offers shall be sent by participants of the request for proposals to the buyer. Selection of the winner of one of the participants is carried out through acceptance of the offer by the buyer.
