Under the Treaty the new tenant (third person) undertakes to exercise all the rights and obligations of JSC «energoprom-ČEZ» under the Treaty of 16.06.2017 № 1045.
JSC «energoprom-ČEZ guarantees that at the time of the signing of the contract of assignment of the rights and duties of all the conditions of the lease agreement, including payment of rent during the period of the lease are met in full, in a timely and appropriate manner precluding any reasonable claim on the part of the lessor. JSC «energoprom-ČEZ guarantees, land no one sold in dispute and under arrest (Prohibition) is not, has not contested, not burdened by easements, and subarendoj.
This Treaty shall be subject to mandatory State registration. It is anticipated that the documents for registration of an assignment of rights and duties will be sent to the registering authority within 3 (three) working days from the receipt of the approval of the Chief of forest management of the Chelyabinsk region to commit the transaction.
Commercial proposal must necessarily be accompanied by the following documents:
1. Bylaws (as amended and supplemented, if they were).
2. Extract from the UNIFIED STATE REGISTER.
3. Balance sheet as of the last reporting date with tax authority stamp of acceptance.
4. Documents confirming the powers of the representative to sign documents and participation in specific procedures:
-Decision (Protocol).
-Power of attorney.
7. Other documents
This RFP procedure is not a tender, and its implementation is not subject to Articles 447-449, Part 1, of the Civil Code of the Russian Federation. This bidding procedure is also not a public auction and is not subject to Articles 1057-1061, Part II, of the Civil Code of the Russian Federation.
