Comments: 1. This Auction is held in accordance with the rules and using the functionality of the b2b-mrsk ETP System.
2. The procedure for holding an auction and participation in it, as well as instructions for the preparation of auction bids, are given in section 2.
3. The Auction Bidder's auction application, together with the price offered by the Auction Participant in the course of the Auction, has the legal status of the offer and will be considered by the Auction Organizer accordingly.
4. Any legal or physical person (including an individual entrepreneur) can participate in the Auction. The involvement of subcontractors / co-contractors / countering officers, participation of collective Participants (group of persons, simple partnership, etc.) is not allowed.
5. In order to qualify for victory in the Auction and to obtain the right to conclude a Contract, the Auction Participant must meet the following requirements:
a) The Auction Participant must possess the necessary professional knowledge and experience, have resource capabilities (financial, logistical, production, labor), have managerial competence, experience and a positive reputation.
b) have civil legal capacity in full for the conclusion and execution of the Agreement (an individual - to have full legal capacity for the conclusion and execution of the Agreement);
c) The Participant in his Proposal is obliged to indicate the terms of payment, not worse than those specified in the draft supply contract (Section 3) (confirmed by the Protocol of disagreement to the draft Agreement (Form 8);
d) the Auction Participant in the Offer is obliged to indicate its validity period in accordance with clause 2.4.3.1; (The validity of the Proposal is indicated in the Letter of Offer (Form 1));
e) the Participant of the Auction must not be insolvent or bankrupt, be in the process of observation, financial rehabilitation, external management, bankruptcy proceedings, provided for by the Federal Law No. 127 of the Federal Law of October 26, 2002, be in the process of liquidation, on the property of the Participant of the Auction to the extent essential for execution The contract should not be seized, the economic activities of the Auction Participant should not be suspended;
f) The Participant of the Auction for the last 24 (twenty four) months, including the month of opening of the envelopes with Offers, shall not have: claims of the Customer (IDGC of the North-West PJSC and its branches) recognized by the Participant or court decisions entered into legal force on the Customer’s claims (IDGC of the North-West PJSC and its branches) are not in favor of the Participant due to non-fulfillment of contractual obligations to the Customer (PJSC "IDGC of the North-West" and its branches).
g) The auction participant accepts used transformer oil for its further disposal (waste utilization, including recycling, as well as return to the production cycle after regeneration and recovery) for its own purposes. If the company is an intermediary in the transfer of waste to third parties, it is necessary to provide copies of contracts with 3 persons stating that the waste (oil) is accepted for its further disposal for its own purposes, or to confirm the transfer of oil for disposal by other documents. If the chain of intermediaries includes the number of participants more than 2, copies of contracts (other documents) with each intermediary to the final recipient of the departure are attached accordingly.
h) The auction participant must have a license "for collecting, transporting, processing, recycling, neutralizing, disposing of waste of I-IV hazard classes" in the part of activities related to their competence. If the auction participant is an intermediary in transferring waste to third parties, it must provide its own license in terms of "transporting" the waste, as well as the license of 3 persons in the framework of waste management activities related to the competence of each participant in the chain of intermediaries.
i) The auction participant must have the necessary experience in performing similar work (documented: reviews of counterparties of previously performed work, data on the volume of purchases of oil, worked in 2016-2017 and 11 months of 2018), positive business reputation, and also have the resource potential (financial, logistical, production, labor), including qualified personnel who have the necessary approvals and permits to perform work on the subject of the auction.
