Delivery terms:Proposals received after the tender will not be considered. Proposals not duly executed and / or not containing a complete set of documents may also not be considered. In the event that the lowest price proposed by the Participants in the procedure exceeds the estimated price determined by the Procurement Organizer, the procedure may be declared invalid.
In the event that the Participant, after conducting competitive procedures, proposes to change the terms of the transaction for the worse, the Participant may be suspended from entering into a transaction.
The tender is the procedure established by the Company to select a person (legal entity or individual entrepreneur) - the winner of the tender, to negotiate with him to agree on the material and other terms of the contract of the relevant type for the purpose of subsequent conclusion of the contract.
Tender procedures are not tenders; their conduct is not regulated by Articles 447–449 of the Civil Code of the Russian Federation. These procedures are also not a public tender and are not governed by Articles 1057-1061 of the Civil Code of the Russian Federation, which does not impose on the Company an appropriate amount of civil law obligations for the mandatory conclusion of an agreement with the winner of the tender or its other participant.
The tender participant at its own expense bears all the costs associated with the preparation and submission of the necessary documents for participation in the tender. The company has no obligation to reimburse the tenderers for the expenses incurred by them and any other costs associated with the preparation for participation and participation in the tender (real damage), and lost profits regardless of the results of the tender.
In case of failure to reach agreement on the terms of the contract, the Company has the right not to conclude a contract with the winner of the tender. The company has the right at any stage to refuse to hold a tender, negotiate and / or conclude an agreement. Moreover, the Company has no obligation to reimburse the bidders or the winner of the tender for the expenses incurred by them and any other costs (real damage) and lost profits.
