Delivery terms:Proposals received after the tender will not be considered. Proposals that are not properly executed and / or do not contain a complete set of documents may also not be considered. If the lowest price offered by the Bidders of the procedure exceeds the estimated price determined by the Procurement Organizer, the procedure may be declared invalid.
In the event that the Participant, after conducting competitive procedures, proposes to change the conditions of the transaction for the worse, the Participant may be excluded from concluding the transaction.
The tender is the procedure established by the Company for the selection of a person (legal entity or individual entrepreneur) - the winner of the tender, to negotiate with him to agree on the material and other terms of the relevant type of contract for the purpose of the subsequent conclusion of the contract.
Tender procedures are not bidding, their conduct is not governed by articles 447 - 449 of the Civil Code of the Russian Federation. These procedures are also not a public tender and are not governed by Articles 1057-1061 of the Civil Code of the Russian Federation, which does not impose on the Company an appropriate amount of civil-law obligations on the mandatory conclusion of a contract with the tender winner or another participant.
The tenderer at his own expense bears all costs associated with the preparation and filing of the necessary documents for participation in the tender. The company has no obligation to reimburse bidders for their expenses and any other costs associated with preparing for participation and participation in the tender (real damage), and loss of profits, regardless of the tender results.
In case of failure to reach an agreement on the terms of the contract, the Company has the right not to enter into an agreement with the tender winner. The company has the right to refuse from holding a tender, negotiating and / or entering into an agreement at any stage. At the same time, the Company has no obligation to reimburse the participants or the winner of the tender of expenses incurred by them and any other costs (real damage) and loss of profits.
