| Условия поставки: | By order of the Customer, the Contractor assumes obligations to carry out a range of works and / or to provide services for the design and construction of the Customer's Object - a fiber-optic communication line (hereinafter referred to as "FOCL"): transmission lines, physical circuits and line-cable structures (hereinafter referred to as "LKS") communications) (hereinafter referred to as "Object", "Objects", "FOCL"). In turn, the Customer agrees to accept the result of the work and / or services provided and to pay for them.
In accordance with the Agreement, the Contractor will perform the following main works / services (not limited to the above):
a) Preliminary inspection of the territory and selection of the Object route, including preparation and approval by the Customer of the Act for the selection of the Object route in accordance with the statement of work (hereinafter referred to as "TK");
b) Obtaining on behalf of the Customer the permissions, approvals, conclusions and technical conditions (hereinafter referred to as "TU") of supervisory, coordinating and other bodies and organizations required in accordance with the current legislation of the Russian Federation (taking into account regulatory legal acts of constituent entities of the Russian Federation and local governments), and also the owners / authorized owners of communications and any other objects for placement / laying of fiber-optic cable (hereinafter referred to as "VOK") in the telephone sewage system, over the supports of overhead power transmission lines (hereinafter - " VL ") and for any other facilities, for the introduction of FOCs into existing and newly constructed buildings and structures, as well as for the design and construction of the Facility; in the case of excavation work for the location of fiber optic links on and (or) below the land (forest) plots, work on the suspension of fiber optic cables on poles and pipe racks, works on the placement of fiber optic cables in telephone conduits, on overhead lines, at any other objects - all the necessary actions are performed, aimed at concluding lease / use / easement agreements with owners / legal owners of buildings, premises, land (forest) plots, structures, supports, telephone sewers, overhead lines or other objects used to place woks (hereinafter referred to as "Placements" "), Including, but not limited to, negotiating with the owners / legal owners of the Locations, arranging for the signing of contracts, ensuring state registration of contracts / arising encumbrances, if necessary according to the current legislation (hereinafter" Lease Agreements "," easement agreements ", "Contracts for the placement of FOCLs").
c) Design and survey work
d) Construction and repair work carried out in accordance with the technical conditions set forth in the working and design documentation; installation, measuring, commissioning, works to eliminate defects; installation, installation of telecommunication equipment;
e) Purchase, delivery to the place of work and storage at the construction sites of materials and equipment (hereinafter - the Materials) necessary for the implementation of construction and installation works in accordance with the design documentation;
f) Execution of executive documentation, a complex of measurements and registration of measurement protocols on cable communication lines;
g) Executive geodetic survey: preparation of a technical report, a catalog of coordinates and topographic plans on a scale of 1: 2000 and 1: 500 along the entire length of the constructed fiber optic link;
h) Registration of other necessary documentation for construction and installation work;
i) In the case of the creation of an object of capital construction (LKS, other objects) - receipt in the name of the Customer of all permits and other documents necessary according to the legislation for the construction and commissioning of the Object, including in accordance with Articles 51, 55 of the Town Planning Code of the Russian Federation, notification of supervisory authorities (including state construction supervision bodies) and interested organizations about construction and installation works, as well as execution of a technical plan, cadastral passport and state registration certificate ownership rights to the LKS of the Object in the name of the Customer;
j) Establishing the boundaries of the protection zone and recording information about the protection zone of the Object in the State Property Committee (State Real Estate Cadastre), including the preparation of a document defined by the legislation of the Russian Federation containing a text and graphic description of the location of the boundaries of the protection zone, as well as a list of coordinates of the characteristic points of the boundaries of the protection zone in the coordinate system established for maintaining the state cadastre of real estate, obtaining an act of the authorized body on the establishment of the protection zone of the Object and approval of its borders echenie entering information about the protection of objects of the zone in the OCG in the amount and manner prescribed by Art. 10 of the Federal Law of July 24, 2007 No. 221-ФЗ "On the State Real Estate Cadastre", Clause 4 and Clause 17 of the Rules for the submission by state authorities and local authorities of the documents necessary for entering information into the State Real Estate Cadastre, to the federal body executive authority authorized in the field of state registration of rights to real estate and transactions with it, cadastral registration and maintaining the state real estate cadastre, as well as the requirements for the format of such documents in electronic form form approved by Decree of the Government of the Russian Federation of February 03, 2014 No. 71, paragraph 14 of the Procedure for maintaining the state real estate cadastre, approved by Order of the Ministry of Economic Development of the Russian Federation of 04.02.2010 No. 42, with the receipt of supporting documents (extracts from the State Property Committee on land plots / zone with special conditions for the use of the territory (security zone), certificates, other);
k) Other work / services necessary to create the Customer's Object.
Work is performed (services are provided) on the basis of Additional Agreements concluded in the form of Appendix No. 1 to this Agreement. An integral part of the Supplemental Agreement is the Terms of Reference (TOR), drawn up in the form of Appendix No. 3 to this Agreement. Additional agreements determine the names, volumes, cost, terms of the beginning and end of work (services).
The scope of work / services for the construction of a particular Object and the contract prices for them are determined by the relevant Additional Agreement to this Agreement. The prices for the works / services performed by the Contractor are determined by the "Tariff and Price Indicators" (TP), the prices of the works / services specified in the Supplementary Agreements, but not reflected in the TC, are determined on the basis of estimates separately agreed by the Parties for a particular case.
Acceptance of the performed works / services or their parts is carried out in accordance with the current legislation of the Russian Federation.
Based on the results of the acceptance of the Object, provided that the Works / services are provided in accordance with this Agreement, the design documentation, the current legislation of the Russian Federation, and the provision of the documentation provided for by this Agreement to the Customer, the Acceptance Certificate of the performed works / services rendered under the Agreement is signed (in the form of Appendix No. 7), with the execution of Acts in the form No. KS-2, No. KS-3, No. KS-11.
The moment of transfer of ownership of the result of work to the Customer is determined by the date of signing by both Parties of the Act of acceptance of work performed / services rendered under the Agreement. |
