The request for proposals does not constitute an auction (tender, auction) in accordance with Articles 447 — 449 of the Civil Code of the Russian Federation or a public tender in accordance with Articles 1057 - 1061 the Civil Code of the Russian Federation, or other regulated procurement procedures (procurement methods) provided for by the legislation of the Russian Federation.
The Organizer has the right to refuse to make a request for proposals, as well as complete the request for proposals procedure without concluding an agreement based on its results at any time, while the Organizer does not refund costs incurred by the participant in preparing and participating in the request for proposals procedure. The Organizer has the right to amend the Notice and Documentation, as well as extend the deadline (date and/or time) for submitting the Proposals.
In accordance with the provisions of subparagraph 1) clause 2.1. Article 1 of Federal Law No. 223-FZ dated July 18, 2011 "On Procurement of Goods, Works, Services, Certain Types of Legal Entities", the effect of this of the federal law does not apply to the activities of Unipro PJSC related to the procurement of goods (works, services), since the total revenue of Unipro PJSC from the activities related to the field of activity of natural monopolies, as well as from regulated types of activities specified in No. 223-FZ dated July 18, 2011, does not exceed 10% of the total revenue from all types of activities carried out by Unipro PJSC.
