5. This request for proposals procedure is not a tender and its conduct is not governed by Articles 447-449 of Part 1 of the Civil Code of the Russian Federation;

7. Therefore, this request for proposals procedure does not impose on the Customer an appropriate amount of civil law obligations.
8. The pro forma agreement is not a public offer, however, the terms of the Agreement will be binding on the winner of the tender.
