Обоснование: Согласно п. 12.4.9. Положения о закупке товаров, работ, услуг ООО «МПК» от 10.03.2016 г. (далее – «Положение о закупке»), в случае если до окончания срока подачи Заявок, установленного Документацией, Заказчиком будет получена только одна Заявка или не получено ни одной Заявки, Запрос котировок признается несостоявшимся.
Согласно п. 12.4.10. Положения о закупке, если до окончания срока подачи Заявок, установленного Документацией, Заказчиком будет получена только одна Заявка, несмотря на то, что Запрос котировок признается несостоявшимся, Комиссия по закупке откроет доступ к поданной Заявке и рассмотрит ее в порядке, установленном Положением о закупке. Если рассматриваемая Заявка и подавший такую Заявку Участник закупки соответствуют требованиям и условиям, предусмотренным Документацией, Заказчик заключит договор с Участником закупки, подавшим такую Заявку на условиях Документации, проекта договора и Заявки, поданной Участником. Такой Участник не вправе отказаться от заключения договора с Заказчиком.
Согласно п. 12.9.1. Положения о закупке, в случае если Запрос котировок признан несостоявшимся, Заказчик заключает договор с единственным Поставщиком в соответствии с п. 5.4. Положения о закупке и в порядке, предусмотренном п.13 Положения о закупке.
