На основании Письма Филиала №3 №04-1806 от
11.10.2018 года, согласно п.5 ст.1 Положения о
закупке товаров, работ, услуг для нужд
Акционерного общества «Государственная компания
«Северавтодор», утверждённого Протоколом совета
директоров АО «ГК «Северавтодор» №4 от 17 августа
2015 года, с последующими изменениями (далее –
Положение о закупке):
- данная закупка не является торгами, не
регулируется статьями 447-449 части первой
Гражданского кодекса Российской Федерации
(неторговая закупка);
- данная закупка не является публичным конкурсом и
не регулируется статьями 1057-1061 части второй
Гражданского кодекса Российской Федерации;
- проведение неторговых закупок не накладывает на
Заказчика гражданско-правовых обязательств, в том
числе по обязательному заключению договора;
- Заказчик вправе на любом этапе неторговой
закупки вплоть до заключения договора отказаться
от её проведения.
