The General Contractor has the right to make payment earlier than the term stipulated by this paragraph of the Agreement, if the Contractor applies with justification for the need for early payment;
- Payment of 7% of the cost of work specified in the KS-3 form approved by the General Contractor (hereinafter referred to as the "reservation amount") is made by the General Contractor within the time period stipulated in clause 5.1.2 of the Agreement.
At the same time, the Parties confirm that the amount of the reservation is a guarantee retention that performs a security function and is a way to ensure the fulfillment of the Contractor's obligations under the Agreement. The General Contractor has the right to satisfy his claims against the Contractor through such withholding, including, but not limited to: a commensurate reduction in the price of work, reimbursement of expenses for eliminating deficiencies (including for warranty obligations), payment of fines and penalties.
