Comments: "MANDATORY ACCEPTANCE OF THE CONTRACT IN THE EDITORIAL OFFICE OF THE CUSTOMER.
1. The cost of the equipment repair services offered by the Contractor shall be based on the cost of materials and services as specified in Schedule 1 to the specification. The equipment delivered to the Contractor's production facility shall be repaired within 10 working days from the date of delivery of the equipment.
2. Contractor requirements:
1) Availability of production base not more than 500km from the city of Almetyevsk RT - property or rent.
2) Experience of air defense repair at least 3 years (confirmed by contracts).
3) Availability of material and technical resources for the work:
- Stand for hydraulic testing of air defense (ownership or lease with supporting documents).
- Stand for testing air defense by inert gas (ownership or lease with supporting documents).
- Lathe machine (ownership or lease with supporting documents).
- Welding semi-automatic (property or rent with supporting documents).
- Apparatus for surfacing (property or rent with supporting documents).
- Milling machine (ownership or rental with supporting documents).

3. In case of failure of the equipment owned by the Customer (due to the Contractor) during the warranty (post-repair) period, as well as identification of the failure of the equipment owned by the Customer In the course of performance of works (services), the Customer has the right to collect from the Contractor a fine in the amount of the cost of downtime (unproductive works) of the drilling rig (by type of VU) based on the cost of one hour of idle time (Annex No. 5 to the contract, the cost of idle hour is adjusted unilaterally once a quarter), but not more than the cost of repair. In the absence of downtime (unproductive work) of the drilling rig, the Customer shall be entitled to charge the Contractor a fine of 50,000 rubles and the actual costs incurred for dismantling the failed equipment and assembly of circulating equipment.$
4. In case of violation of terms of repair of equipment according to the terms of this contract on the basis of mutually agreed list and monthly repair plan, the Contractor will be subject to penalties in the amount of 3% of the cost of performed works on this repair for each week of delay.
5. In case of failure of the warranty equipment, the Customer has the right to dismantle it without agreement with the Contractor. Upon the arrival of the Contractor at the facility (well), the parties shall set up a commission consisting of competent, authorized representatives of the Customer and the Contractor who are able to determine the guilty party without additional investigation in shop conditions, appointed by orders on enterprises. The commission investigates and determines (determines) the cause of failure of the equipment, with obligatory registration and signing of the act of investigation of the incident on both sides.
6. The Commission shall determine the party who committed the incident directly at the drilling site on the day of the investigation, and if there is no evidence of the fault of the Employer, $ is recognized by the Contractor. Who, in case of disagreement with the decision of the commission, after the removal of the equipment to the Contractor's base (transport is provided by the Contractor), carrying out additional investigation at his own expense, has the right to submit proof of the innocence in the incident and to refute the decision of the commission. In the course of further investigation, the Contractor shall ensure the presence of the Customer's representative and call him well in advance. Additional investigation shall be carried out only at the Contractor's premises (it is excluded that the subcontractor's production facilities are subject to investigation). The equipment delivered to the Contractor's production facility shall be repaired within 10 working days from the date of delivery of the equipment.
7. Following the results of the investigation, the commission prepares an investigation report, which the parties are obliged to sign, refusal to sign the act is not allowed. In case of refusal of the representative of the guilty party to sign the act, the act shall be deemed to be signed in favor of the other party, which shall be noted in the act.
This act is the basis for compensation (payment) by the guilty party for damages caused by the incident, idle or unproductive work at the expense of the guilty party, including penalties, $ presented to the customer by third parties.
In the event that the Contractor is found guilty, this act is the basis for the Customer's claim against the Contractor. Compensation (payment) of losses, including penalties, shall be carried out by adjusting, in the direction of reduction of the volume of work performed by the Contractor by the amount of losses (fine) and payment of performed works taking into account the deduction of the cost of downtime (unproductive time) specified in the claims submitted and recognized by the Contractor, or left unanswered within 30 calendar days, or transfer of funds to the settlement account of the Customer on the basis of the claim. "
