Party recognized the winner of the RFP, is obliged to make a security payment in cash in the amount of 5% of the value of the works referred to in the final offer (excluding VAT), at the expense of JSC «NTJeK», within 10 days of receipt of the notification of the acceptance of the Party the winner of the RFP prior to the conclusion of the contract. After the conclusion of the contract, as agreed with the customer, this security payment may be replaced by a bank guarantee issued in accordance with clause 3.10 of the Treaty. The possibility of replacing a security payment made prior to the conclusion of the contract, the bank guarantee may be considered by the customer on the conditions of p. 3.9.5 contract only after its conclusion.
