Обоснование: на основании п. 4.5.14 Инструкции по проведению закупочных процедур (Приложение № 2 к Положению о закупках ПАО «Т Плюс»): «В случае если только один из участников, подавших заявку, признан участником закупки, закупка также признается несостоявшейся. В этом случае Заказчик вправе: - заключить договор с участником закупки, признанным единственным участником закупки после подписания протокола рассмотрения заявок или после одобрения (согласования) договора органами управления Заказчика. Договор составляется путем включения условий, в том числе о цене, предложенных таким участником в заявке, в проект договора, - провести с таким участником переговоры по снижению цены, представленной в заявке, и заключить договор по цене, согласованной в процессе проведения преддоговорных переговоров, - принять решение о проведении повторной процедуры закупки, при необходимости с изменением условий проводимой закупки, - отказаться от проведения закупки».
