Comments:
To participate in the request for proposals, you must pass accreditation by METALLOINVEST Group of Companies (for non-accredited companies), as well as prepare a technical and commercial proposal (hereinafter TCH). The TCP must be initialed on every page. The TCH must be valid for at least sixty (60) calendar days.
At this stage, a request for proposals is carried out in order to familiarize the TCH of the Participants, consider and identify the most favorable conditions.
Next, the main price stage (rebidding) will be held, to which the Participants who submitted the most advantageous offers will be admitted. Based on the result of rebidding, a decision is made on the advisability of concluding a supply agreement.
This request for proposals procedure is not an offer, an invitation to make an offer, an acceptance of an offer or an invitation to take part in an auction; its conduct is not regulated by Articles 447-449 of the Civil Code of the Russian Federation. This procedure is also not a public tender and is not regulated by Articles 1057-1061 of Part Two of the Civil Code of the Russian Federation.
The Customer is not obliged to conclude any transactions as a result of the request for proposals procedure, and has the right to refuse all received offers / bids for any reason or to terminate the request for proposals procedure at any time without notifying the Procurement Participants and shall not be liable to the Bidders or third parties to whom such actions may cause losses.
The customer also does not bear any obligations to reimburse the Procurement Participants or other third parties for any costs or other losses associated with participation in the request for proposals procedure.
Thus, this request for proposals procedure does not provide for the fulfillment by the Customer of any civil legal obligations in relation to the Procurement Participants or to third parties.
