MANDATORY REQUIREMENT - SUBMISSION OF A COMMERCIAL OFFER IN THE FORMAT OF AN OFFICIAL LETTER.
Your offer should include the following information:
1. Name and main characteristics of the goods offered for delivery;
2. Delivery time.
3. Terms of payment.
4. The validity period of the offer.
5. The commercial part, namely the price in rubles without VAT (indicating the VAT rate), in the context of each of the items. The price should include the cost of packaging, packaging, marking, registration costs, transportation costs to the Buyer's warehouse in St. Achinsk and other mandatory payments.
Comments: You may provide other information and documents confirming your positive business reputation, experience and financial stability.
Each Supplier shall have the opportunity to participate in the selection for the duration of the selection period.
Please note that the commercial offer submitted by you in the framework of this Supplier Selection must be made in the form of an offer in accordance with Art. 435 and 436 of the Civil Code Russian Federation (hereinafter referred to as the Civil Code) with a term for acceptance within 25 days from the date of its receipt. This offer cannot be withdrawn by you within the specified time limit for its acceptance. There is no charge for the provision of an irrevocable offer.
This Notice does not constitute a public offer in accordance with the Civil Code of the Russian Federation.
This Selection is not an auction (including in the form of a competition, auction or other form) or a public tender governed by Articles 447-449, 1057-1061 of the Civil Code of the Russian Federation, and does not impose on JSC "RUSAL Achinsk" obligations stipulated by the above articles of the Civil Code of the Russian Federation, as well as obligations to conclude a contract of delivery of the Goods with the person who sent the most advantageous offer.
The selection may be cancelled at any time prior to summing up.
In the event of change or cancellation of the Selection, expenses incurred by any person in connection with participation in the Selection, including negotiations, shall not be reimbursed.
Based on the results of the selection, your Commercial offer can be accepted both for the entire volume of the Goods and for its part.
Information about the final results of your participation in this Selection will be sent to you by e-mail.
Selection of the most advantageous offer for JSC "RUSAL Achinsk" is carried out taking into account the evaluation of the following criteria:
- availability of the minimum price in the order;
- Payment within 60 calendar days from the date of delivery of the Goods to the Buyer's warehouse is preferred;
- the goods must be accompanied by a certificate (passport) of quality;
- it is preferable to conclude a contract according to the standard form of JSC "RUSAL Achinsk" (the form of the contract can be provided to the selection participant upon request);
- positive experience of cooperation with companies that are part of RUSAL, as well as interests of our organization.
JSC "RUSAL Achinsk" has the right in order to determine the most advantageous offer and to ensure equal competitive conditions for all participants of the Selection to carry out measures aimed at reducing the price specified in the offer, including (but not limited to) sending to the selection participants a message about the minimum price offered by the supplier (without specifying the selection participant who offered the this price) and to invite all participants to adjust and improve the terms of previously made commercial offers, including by reducing the price of the Goods. Modification of a commercial offer shall be made in the form of a new commercial offer (offer) on the above terms.
JSC RUSAL Achinsk has the right to refuse participation in the Selection in the following cases:
- commercial offer received after the deadline; $
- the terms of the offer do not comply with the terms of this notice;
- the offer contains false information;
- the person submitting the offer is in the process of liquidation or reorganization, or insolvency (bankruptcy) proceedings have been initiated against him; $
- Participant of Selection has negative experience of working with enterprises of OK RUSAL;
- in any other case, on the basis of internal procedures, with the right not to explain the reasons for the refuse.$
JSC "RUSAL Achinsk" has the right not to motivate its decision to determine the winner of the selection.
In case of recognition of your offer the most advantageous, JSC "RUSAL Achinsk" has the right to conclude a contract with your organization, including by acceptance sent by commercial proposal (s) within the time limit set for its acceptance.$
The information provided by you to participate in the Selection will not be disclosed to persons not related to the Selection, as well as to other Participants in the Selection, except for a notice of the minimum price.
In case of recognition of your organization as the winner on the result of this selection, for conclusion of the Contract of delivery it is necessary to pass the procedure of accreditation. The list of documents required for accreditation of the Supplier is presented in the procurement documentation - Appendix №3. If your organization refuses to submit documents for Accreditation (in whole or in part), please send a written notice to us.
