Requirements to the bidders:
Bidders who have offered the best conditions for the execution of the Contract and meet the following requirements can claim to win the competition:
a) compliance of the Bidder with the requirements established in accordance with the legislation of the Russian Federation for persons performing the obligations that are the subject of the Contract, including the presence of:
• licenses of the Federal Service for Technical and Export Control (FSTEC of Russia) for the technical protection of confidential information (not containing information constituting a state secret, but protected in accordance with the legislation of the Russian Federation) (subject to the provisions of Part 4 of Article 22 of Federal Law No. 99-FZ dated 05/04/2011 "On Licensing of Certain Types of Activities"), issued in accordance with the Decree of the Government of the Russian Federation dated 02/03/2012 No. 79 "On licensing activities for the technical protection of confidential information", on:
- works and services on design in protected execution: means and systems of informatization;
- services for installation, installation, commissioning, testing, repair of information security equipment (software (software-technical) information security equipment, protected software (software-technical) information processing equipment, software (software-technical) information security control equipment);
• licensed by the Federal security service of the Russian Federation (FSB), to carry out activities for the development, production, distribution of encryption (cryptographic) tools, information systems and telecommunication systems protected using encryption (cryptographic) means, performance of works, rendering of services in the field of information encryption, maintenance of encryption (cryptographic) tools, information systems and telecommunication systems protected using encryption (cryptographic) means (except if the maintenance of encryption (cryptographic) tools, information systems and telecommunication systems protected using encryption (cryptographic) funds are for the own needs of a legal entity or individual entrepreneur), issued in accordance with the decree of the Government of the Russian Federation dated 16.04.2012 № 313 "On approval of the Regulations on licensing of activities for the development, production, distribution of encryption (cryptographic) tools, information systems and telecommunication systems protected using encryption (cryptographic) means, performance of works, rendering of services in the field of information encryption, maintenance of encryption (cryptographic) tools, information systems and telecommunication systems protected using encryption (cryptographic) tools (with the exception of the case if the maintenance of encryption (cryptographic) tools, information systems and telecommunication systems protected using encryption (cryptographic) means, performed for the own needs of a legal entity or individual entrepreneur)" (subject to the provisions of paragraph 4 of article 22 of the Federal law dated 04.05.2011 № 99-FZ "On licensing certain types of activities"), for the following types of the performed works and rendered services:
- installation, installation (installation), adjustment of encryption (cryptographic) means, with the exception of encryption (cryptographic) means of protection of fiscal data, developed for use as part of cash register equipment certified by the Federal Security Service of the Russian Federation, and encryption (cryptographic) means developed for use as part of the technology implemented by intermediate elements intelligent electric energy (power) metering system and electric energy metering devices certified by the Federal Security Service of the Russian Federation (12);
- transfer of encryption (cryptographic) means, with the exception of encryption (cryptographic) means of protecting fiscal data, developed for use as part of cash register equipment certified by the Federal Security Service of the Russian Federation, and encryption (cryptographic) means developed for use as part of a technology implemented by intermediate elements of an intelligent electric energy (power) metering system) and electric energy metering devices certified by the Federal Security Service of the Russian Federation (21);
b) failure to liquidate the Bidder – a legal entity and the absence of a decision of the arbitration court to declare the Bidder – a legal entity, an individual entrepreneur bankrupt and to open bankruptcy proceedings;
c) non-suspension of the Bidder's activities in accordance with the procedure provided for by the Code of Administrative Offences of the Russian Federation as of the date of submission of the Tender Bid;
d) submission of the information provided for in clause 5.1.4 of the Tender documentation;
e) the Bidder has no arrears in taxes, fees, arrears in other mandatory payments to the budgets of the budgetary system of the Russian Federation (with the exception of amounts for which a deferral, installment, investment tax credit has been granted in accordance with the legislation of the Russian Federation on taxes and fees, which have been restructured in accordance with the legislation of the Russian Federation, for which there is a court decision that has entered into legal force on recognizing the applicant's obligation to pay these amounts fulfilled or which are recognized as uncollectible in accordance with the legislation of the Russian Federation on taxes and fees) for the past calendar year, the amount of which exceeds 25% (Twenty-five percent) of the book value of the assets of the Bidder, according to the accounting statements for the last the reporting period. The Bidder shall be deemed to comply with the established requirement if, in accordance with the established procedure, he has filed an application to appeal the said arrears, arrears and the decision on such application as of the date of Bid evaluation for participation in the determination of the supplier (contractor, contractor) has not been made;
f) the absence of information about the Bidder in the register of unscrupulous suppliers provided for in Article 5 of Federal Law No. 223-FZ of 07/18/2011 "On Call for Bidding of Goods, Works, Services by Certain Types of Legal Entities" and (or) in the register of Unscrupulous Suppliers provided for by Federal Law No. 44-FZ of 04/05/2013 "On the contract System in the Field of Calls for Bidding of goods, works, services to meet state and municipal needs";
g) the Bidder – a natural person or the head, members of the collegial executive body or chief accountant of a legal entity - a Bidder has no criminal record for economic crimes and (or) crimes provided for in Articles 289, 290, 291, 291.1 The Criminal Code of the Russian Federation (with the exception of persons whose criminal record has been expunged or removed), as well as the non-application of punishment in the form of deprivation of the right to hold certain positions or engage in certain activities related to the supply of goods, performance of work, provision of services that are the subject of ongoing Call for Bidding, and administrative punishment in the form of in the form of disqualification;
h) the absence of facts of bringing a legal entity Bidder to administrative responsibility for committing an administrative offense under Article 19.28 of the Code of Administrative Offenses of the Russian Federation within 2 (two) years prior to the filing of the bid for the commission of an administrative offense provided for in Article 19.28 of the Code of Administrative Offenses of the Russian Federation;
i) the absence of information about the Bidder in the register of foreign agents provided for by Federal Law No. 255-FZ dated 07/14/2022 "On Control over the Activities of Persons under Foreign Influence".

A Bidder whose Tender Bid (final offer) meets the requirements established by this Tender Documentation, and whose Tender Bid (final offer), based on the results of comparison of Tender bids (final offers) on the basis of the evaluation criteria specified in the Tender Documentation, contains the best conditions for the performance of the Contract.
Contract conclusion date:
The contract based on the results of the tender between the Customer and the Winner of the tender is concluded no earlier than 10 (Ten) days and no later than 20 (Twenty) days from the date of posting in the unified information system of the final protocol drawn up based on the results of the tender.
The contract is concluded in writing by drawing up one document signed by the parties.

1. Срок поставки Экземпляров программ для ЭВМ, указанных в Спецификации Экземпляров программ для ЭВМ (Приложение № 3 к Договору) – 01.08.2024.
2. Сроки выполнения Работ по Договору:
– дата начала выполнения Работ по Договору – дата заключения Сторонами Договора;
– дата окончания выполнения Работ по Договору – не позднее 06.12.2024.
