This Selection is not an auction (including in the form of a tender, auction or other form) or a public tender regulated by Articles 447-449, 1057-1061 of the Civil Code of the Russian Federation, and does not impose on JSC "Salavatsteklo" obligations provided for by the above articles of the Civil Code of the Russian Federation, as well as obligations to conclude a service contract with the person who sent the most favorable offer.
The selection can be canceled at any time before the results are summed up.
In the event of a change in the Selection conditions or its cancellation, the costs incurred by any person in connection with participation in the Selection, including those related to participation in negotiations, will not be reimbursed.
Information about the final results of your participation in this Selection will be sent to you by e-mail.
The selection of the most profitable offer for JSC "Salavatsteklo" is carried out taking into account the evaluation of the following criteria:
- conclusion of the Contract according to the standard form of JSC "Salavatsteklo" (the contract form can be provided to the selection participant upon request);
JSC "Salavatsteklo" has the right, in order to determine the most favorable offer and ensure equal competitive conditions for all participants of the Selection, to carry out measures aimed at reducing the price indicated in the offer, including (but not limited to) to send a message to the participants of the Selection about the minimum price of Services offered by the supplier (without specifying the participant of the Selection who offered this price) and to invite all participants of the Selection to adjust and improve the conditions of previously made commercial offers, including by reducing the price of the Service. The change of the commercial offer must be made in the form of a new commercial offer (offer) on the above conditions.
JSC "Salavatsteklo" has the right to refuse to participate in the Selection in the following cases:
- the commercial offer was received after the deadline;
- the terms of the commercial offer do not comply with the terms of this notice;
- the commercial offer contains false information;
- the person who sent the commercial offer is in the process of liquidation or reorganization, or insolvency (bankruptcy)proceedings have been initiated against him;
- in any other case, on the basis of internal procedures, with the right not to explain the reasons for the refusal.
JSC "Salavatsteklo" has the right not to motivate its decision to determine the winner of the selection.
If your commercial offer is recognized as the most profitable, Salavatsteklo JSC has the right to conclude a contract with your organization, including by accepting the sent commercial offer (offer) within the period established for its acceptance.
The information provided by you for participation in the Selection is not disclosed to persons who are not related to the Selection process, as well as to other participants of the Selection, except for the message about the minimum price.
If your organization is recognized as the winner according to the results of this selection, it is required to pass the accreditation procedure to conclude a Service Contract. The list of documents required for the Supplier's accreditation is provided in the procurement documentation. If your organization refuses to submit documents for the Accreditation procedure (in whole or in part), please send a written notification to our address.
Please note that this price market monitoring is a procedure that allows the organizer to determine the initial maximum price of the subsequent purchase procedure and does not impose obligations on the organizer to conclude a contract.
