Comments:
The procedure is the method established by ZTSU LLC for selecting a supplier for negotiating with him to agree on the essential and other terms of an agreement of the corresponding type in order to conclude a contract later. It is not an auction, and the holding is not regulated by Articles 447-449 of the Civil Code of the Russian Federation, it is also not a public tender and is not regulated by Articles 1057-1061 of the Civil Code of the Russian Federation, which does not impose on ZTSU LLC an appropriate volume of civil legal obligations on the mandatory conclusion of an agreement with The Winner or another Participant. A participant in the procurement procedure at his own expense bears all costs associated with the preparation and participation in the procurement procedure (real damage), and lost profits, regardless of the results of the procurement procedure. The Participant at his own expense bears all costs associated with negotiations with LLC "ZTSU" to agree on the essential and other terms of the agreement of the corresponding type, and LLC "ZTSU" has no obligation to reimburse the Winner for the costs incurred by him and any other costs associated with the negotiation (real damage), and lost profits regardless of the outcome of the negotiations. In case of failure to reach an agreement under the terms of the agreement, ZTSU LLC has the right not to conclude an agreement with the Winner. LLC "ZTSU" has the right at any stage to refuse to conduct the procurement procedure, negotiate and / or conclude an agreement by sending a notification about this to the Participants or the Winner or by posting a message on the official website of LLC "ZTSU". At the same time, LLC ZTSU has no obligation to reimburse the Participants or the Winner of the procedure for the costs incurred by them and any other costs (real damage) and lost profits.
