Mandatory conditions for the CONTRACTUAL counterparty:
1. The consent of the Contractual counterparty to the cost of transportation costs for 10 km of travel. The cost of 10 kilometers is calculated from the actual address of the Contractor to the address of the Customer's facility (one way). Periodicity - according to need.
Cost 43.33 rubles. excluding VAT (52.00 rubles including VAT)
2. Check-out at the bidding of the customer and repair of the breakdown, within 24 hours, in case of receipt of a bid for emergency work (see Equipment repair Agreement)
3. Consent to the delivery of components for repair and the provision of services for their replacement, according to the approved prices in the tariff (see Sheet No. 2 and No. 3)
4. Consent to 100% post-payment within 60 calendar days from the date of signing the closing documents.
5. The presence of its own representative office in the service region or adjacent areas.
6. Ensuring compliance with the provisions of Section 5 (Repair, reconstruction or modernization of PS OPO) Federal norms and rules in the field of industrial safety "Safety Rules for hazardous production facilities where lifting facilities are used" (approved by Rostechnadzor Order No. 461 dated 11/26/2020), as well as the performance of all duties within the area of responsibility of a specialist, responsible for maintenance in working condition
7. The Contractor provides the Customer with a quality guarantee for the results of the Work performed for a period of 1 (one) one year (warranty period) from the date of signing the Service Certificate, provided that there is no damage to the equipment as a result of acts of vandalism or exposure to external causes, including unintended actions by third parties.
8. The Contractor provides the Customer with a quality guarantee for components, assemblies and parts (spare parts) of lifting machines, which were replaced during Maintenance and repair by 1 (one) one year (warranty period) from the date of signing the Service Certificate, provided, unless otherwise specified by the manufacturer, these units, assemblies and parts (spare parts).
9. Work experience of 3 years, in this industry, confirmed by the existence of existing contracts with other customers or other supporting facts and documents
10. The number of employees engaged in maintenance and repair must comply with the recommended standards for labor rationing of workers and the letter of the Ministry of Construction and Housing and Communal Services of the Russian Federation dated January 3, 2021 n 480-og/04, based on the quantitative ratio of facilities for maintenance, declared as part of the tender procedure
11. Availability of production facilities
12. The status of a legal entity and the organizational form must comply with the requirements of the legislation of the Russian Federation
13. Availability of the necessary personnel, as well as managers and specialists who have the authority necessary to perform their duties; having at least 3 qualification groups for electrical safety and knowledge of safety rules for working with lifting facilities. The presence in the staff of ITP having certification under Article b 9.33. Federal norms and rules in the field of industrial safety "safety rules for hazardous production facilities where lifting facilities are used" (approved by Rostechnadzor Order No. 461 dated 11/26/2020)
14. The presence of its own representative office in the service region or adjacent areas
15. Availability of own or leased vehicles, in the amount that allows you to carry out labor activity, based on the quantitative ratio of objects, for taking on maintenance, declared as part of the tender procedure
16. Absence of initiated cases and overdue obligations to third parties
17. In case of violation of the deadlines for performing maintenance Work, as well as in case of violation of the deadlines for performing other Work specified in Clause 3 of Appendix No. 3 to this Agreement, the Contractor shall pay, at the request of the Customer, a penalty in the form of a reduction in the cost of Equipment maintenance (subscription fee), taking into account the level of service provided, calculated in accordance with Service Level Agreement - Appendix No. 12 of the Agreement (see the Agreement).
18. In case of violation of the 24 (twenty-four) hour response period specified in this clause by the Contractor, the Customer has the right to entrust the execution of Works not performed by the Contractor to third parties. In the latter case, the Contractor compensates for all losses of the Customer, including compensating for the cost of works / services paid by the Customer to the above-mentioned third parties.
19. For the untimely release of the Object and (or) the adjacent territory from the Contractor's property, remnants of materials, waste and (or) garbage, the Contractor, at the request of the Customer, pays the latter a fine of 1,000 (one thousand) rubles for each day of delay in fulfilling the aforementioned obligation (the fine is payable for each fact of violation)
20. The Contractor must arrange the processing of Bids from the Customer in the automated 1C Bid registration system, around the clock, including holidays and weekends.
21. In cases where maintenance work is not carried out in full, according to the list of works specified in the Act of Rendering Maintenance Services, the cost of these works is not payable until the identified deficiencies are eliminated and the missing works are carried out, within 2 (two) calendar days from the date the Customer submits the relevant requirement.
