Contractor requirements
Experience:
• For the successful implementation of the project, the staff of the contracting organization must have specialists with experience in the successful implementation of automation projects for the smart system of the enterprise and production control at a permanent place of work.
• The main requirements for the team are at least 4 people with an expert level in the implementation of operational production management systems, industrial safety of a smart system and production control systems at enterprises for at least 6-10 years.
Organizational and technical capabilities of the contractor:
• Availability of project team personnel in an amount sufficient to fulfill the declared scope of work on the project;
• The presence of the system administrator of the KCC, who has passed the certification procedure at the Certification Center (CA), to issue a sufficient number of certificates for the electronic signature verification key (SKPEP) within the time frame specified by the project;
• Availability of the necessary technical means in an amount sufficient for the implementation of project tasks.
Representations and warranties of the contractor's restrictive measures. When performing work on the project, the contractor certifies that:
• the implementation of the project will not and cannot lead to a violation by one of the parties to the Economic Sanctions;
• is not subject to the Economic Sanctions, regardless of whether the contractor is mentioned in the Economic Sanctions or not;
• does not own and / or control, directly or indirectly, legal entities subject to the Economic Sanctions;
• the money paid to the contractor will not be used for purposes prohibited under the Economic Sanctions;
• does not have a business relationship, does not act in the interests of, on behalf of, or at the expense of persons included in the Specially Designated Nationals and Blocked Persons List administered by the Office of Foreign Assets Control of the United States Department of the Treasury, or otherwise similar lists (hereinafter referred to as the "Blocked Persons"), as well as with persons whom the Blocked Persons directly or indirectly control or who directly or indirectly own;
• blocked persons do not receive, directly or indirectly, economic benefits from the performance of work on the project;
• has no business relationship with the government (including its agents, agencies or intermediaries) of the state, as well as with any person who is incorporated in a state subject to the Economic Sanctions;
• the parties agree that for the purposes of Article 431.2 of the Civil Code of the Russian Federation, the reliability of the assurances about the circumstances above is of essential importance for the Contractor and the Customer;
• the contractor undertakes to immediately (no later than the working day following the occurrence of the relevant event) notify the Customer of the occurrence of events as a result of which any of the assurances about the circumstances above may become inaccurate
"Economic Sanctions" means economic, financial or trade sanctions, embargoes or other financial or economic measures of a restrictive nature in accordance with the laws (including Chapter 99 of Title 22 of the United States Code), regulations, regulations or directives enacted or administered by the United States of America, European Union, Switzerland, Russia or adopted by the United Nations
