Responsibility of the parties:
In case of nonperformance or improper performance by the parties of their obligations under the Treaty, the parties bear responsibility in accordance with the terms of the agreement and the legislation of the Russian Federation.
In the event that the customer claim by third parties due to infringement of their patent, copyright or other intellectual rights to results of intellectual activity as a result of unauthorized use of a performer when you run works under the contract intellectual property related rights on which belong to a third party, the contractor fully pays all costs associated with the losses caused to these persons, and court costs.
For delay in payment of the advance payment and final payment, the executor has the right to demand from the customer to the payment of default interest at the rate of 0.01% of the overdue amount for each day of delay in payment, but not more than 10% of the overdue amount.
In case of fault will not be provided with the proper quality and turnaround time, the customer is entitled to withdraw from the contract, to demand compensation for damages, advance payment and the payment of a penalty in the form of a fine in amount of 3% of the total value of the work under the contract.
The application of the penalty does not relieve the parties from performance of the obligations under the Treaty.
