We draw your attention to the fact that the commercial offer provided by you as part of this Selection of Suppliers must be issued in the form of an offer in accordance with Articles 435 and 436 of the Civil Code of the Russian Federation (hereinafter the Civil Code of the Russian Federation) with a period for acceptance within 10 days from the date receiving it. This offer cannot be withdrawn by you within the specified period established for its acceptance. There is no fee for the provision of an irrevocable offer.
This Invitation is not a public offer in accordance with the Civil Code of the Russian Federation.
This Selection is not an auction (including in the form of a competition, auction or any other form) or a public competition regulated by Articles 447-449, 1057-1061 of the Civil Code of the Russian Federation, and does not impose obligations on Salavatsteklo JSC provided for by the above Articles of the Civil Code of the Russian Federation , as well as obligations to conclude a service contract with the person who sent the most advantageous offer.
The selection can be canceled at any time prior to the summing up.
In the event of a change in the conditions of the Selection or its cancellation, the costs incurred by any person in connection with participation in the Selection, including those related to participation in the negotiations, will not be reimbursed.
The final results of your participation in this Selection will be sent to you by email.
The selection of the most advantageous offer for Salavatsteklo JSC is carried out taking into account the assessment of the following criteria:
- conclusion of the Contract according to the standard form of JSC Salavatsteklo (the form of the contract can be provided to the selection participant upon request);
JSC "Salavatsteklo" has the right, in order to determine the most advantageous offer and ensure equal competitive conditions for all participants in the Selection, to carry out measures aimed at reducing the price specified in the offer, including (but not limited to) send a message to the participants in the Selection about the minimum proposed the supplier of the price of the Services (without specifying the Selection participant who offered this price) and propose to all Selection participants to adjust and improve the conditions of previously made commercial offers, including by reducing the price of the Service. A change in a commercial offer must be formalized in the form of a new commercial offer (offer) on the above conditions.
JSC "Salavatsteklo" has the right to refuse to participate in the Selection in the following cases:
- the commercial offer was received after the expiration of the specified period;
- the terms of the commercial offer do not comply with the terms of this notice;
- the commercial offer contains false information;
- the person who sent the commercial proposal is in the process of liquidation or reorganization, or insolvency (bankruptcy) proceedings have been initiated against him;
- in any other case, on the basis of internal procedures, with the right not to explain the reasons for refusal.
JSC "Salavatsteklo" has the right not to motivate its decision to determine the winner of the selection.
If your commercial proposal is recognized as the most profitable, JSC "Salavatsteklo" has the right to conclude an agreement with your organization, including by way of acceptance, a sent commercial proposal (offer) within the period established for its acceptance.
The information provided by you to participate in the Selection is not communicated to persons not related to the Selection, as well as to other participants in the Selection, with the exception of the message about the minimum price.
If your organization is recognized as the winner based on the results of this selection, in order to conclude a Service Agreement, you need to go through the accreditation procedure. The list of documents required for the Supplier's accreditation is presented in the procurement documentation. If your organization refuses to submit documents for the Accreditation procedure (in whole or in part), please send a written notification to our address.
We draw your attention to the fact that this monitoring of the price market is a procedure that allows the organizer to determine the initial maximum price of the subsequent purchase procedure and does not impose obligations on the organizer to conclude a contract.
