Comments:
Dear Sirs!
1. This competitive procedure for the preliminary selection of the Contractor is directed in accordance with the Tender Regulations of the Tender Organizer within the framework of the procedure for requesting commercial offers, which (like the contractor's pre-selection procedure itself) is not an offer, auction or tender and is not regulated by Art. 447-449 part 1 and 1057-1061 part 2 of the Civil Code of the Russian Federation.
Thus, this procedure does not impose on the Organizer the corresponding volume of civil obligations and reserves the right to refuse all received Proposals for any reason or to stop the selection procedure at any time without explaining the reasons, without bearing any responsibility to the Participants.
To participate in the tender it is necessary to send the following package of documents via ETP www.b2b-center.ru:
1. Table of prices and warranty indicators (Appendix No. 2), compiled in accordance with Appendix No. 1 to this invitation (Terms of Reference) and Appendix No. 4 (Requirements of Rusagro to estimates).
2. The documents listed in Appendix No. 3 to this invitation (List of mandatory documents provided by bidders in the application).
3. The official letter of the potential supplier (Applicant) about the absence of circumstances preventing participation in the tender
4. Written consent in free form with the Rules for the performance of works by contractors listed in Appendix No. 5.
The validity of your proposal must be at least 60 (sixty) days from the date of receipt of your proposal. If during the validity of the proposal, an agreement is concluded with your company, the validity period of your offer remains unchanged until the fulfillment of obligations under such contract.
5. The organizer of the tender reserves the right to choose several winners, dividing at their discretion and without explaining the reasons between several potential suppliers participating in the competitive procedure.
6. Organization / documentation that does not meet the requirements and forms specified in the notification, the Organizer has the right to reject without explanation of reasons and to recognize this documentation, and, accordingly, the Applicant does not comply with the requirements of this competitive procedure.
7. Visiting the site to get acquainted with the scope of work is mandatory. It is necessary to visit the plant and meet with the Customer's representatives, contacts are indicated in the Terms of Reference.
8. Conducting a competitive procedure involves directly bidding with the filling of all additional fields of proposals. Candidates are selected according to the documentation provided. The offer must be downloaded before the closing date of the auction, after which the documentation will be checked and the Applicants will be admitted.
9. The prices should be indicated excluding VAT and include all Contractor's expenses for the execution of works, and the Contractor's remuneration.
10. Payment will be made in rubles after the expiration of 35 (thirty five) banking days on the first payment day of the Customer (working Monday and Wednesday) after performance of work and signing Acceptance Acts. If you are unable to confirm the requested payment terms, we ask you to offer your own. Please take into account that any advance should be provided by the Bank Guarantee (not welcomed). Standard penalties are 2.5% per week. (see template agreement - Appendix No. 6)
11. The winner of the tender is approved by the Chairman of the tender committee, based on the results of all the aggregate factors (price, deferred payment, availability / absence of advance, guarantee, standard conditions of Rusagro, terms of performance of works, absence of obstacles to the performance of the contract, quality and completeness of the documentation).
12. All trades for Rusagro's counterparties on ETP B2B are free of charge. EDS at the moment is not required.
