Payment terms:
Advance payment is not provided, payment is made for the work actually performed on the basis of the acts of delivery and acceptance of the work performed, with a deferred payment of at least 30 (thirty) and no more than 40 (forty) calendar days.
The Customer is ready to consider alternative proposals of the Participants (including several) in terms of the order and terms of payment, which will be taken into account when comparing the proposals of the Participants.
If the payment for the works performed by the Contractor is carried out in the order of prepayment, the amount of which exceeds the values established by the organizational and administrative documents of the Customer, and the credit limit is not set for the counterparty, or the amount of the established credit limit is insufficient, the Contractor, until the advance payment is transferred, provides the Customer with an independent guarantee in the original on paper for the refund of the advance payment for the amount of the advance payment. The draft of an independent guarantee for the return of the advance payment must be necessarily pre-agreed with the Customer and meet the requirements of clause 2.6. The standard form of the contract (Appendix No. 3).
Delivery terms:
The total duration of the complex of works, including the supply and installation of materials, should not exceed 30 (thirty) calendar days.
The Customer is ready to consider alternative proposals of the Participants (including several) in terms of the timing of the work, which will be taken into account when comparing the proposals of the Participants.
Comments: The participant of the procurement procedure must
meet the following requirements:
1. The absence of lawsuits from the Participant
of the procurement procedure for the amount of
claims against the latter exceeding 25% of the
company's own capital (confirmed by the
declaration of compliance with the established
requirements by filling in and submitting the form
"Declaration of the Participant of the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
2. Failure to liquidate a Participant in the
procurement procedure-a legal entity and the
absence of an arbitration court decision on
recognizing a participant in the procurement
procedure-a legal entity or an individual
entrepreneur as insolvent (bankrupt) and on
opening competitive proceedings (confirmed by
declaring compliance with the established
requirements by filling in and providing the form
"Declaration of a Participant in the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
3. Non-suspension of the activities of a
Participant in the procurement procedure in
accordance with the procedure established by the
Code of Administrative Offences of the Russian
Federation on the day of filing an application for
participation in procurement (confirmed by a
declaration of compliance with the established
requirements by filling in and providing the form
"Declaration of a Participant in the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
4. The Participant of the procurement procedure
has no overdue arrears on accrued taxes, insurance
premiums, fees and other mandatory payments to
budgets of any level or state extra-budgetary
funds for the last completed reporting period, the
amount of which exceeds 25% of the book value of
the assets of the procurement participant
according to the accounting statements for the
corresponding period. The procurement participant
is considered to meet the established requirement
if he appeals against the existence of the
specified debt in accordance with the legislation
of the Russian Federation and the decision on such
a complaint has not been made on the day of
consideration of the application for participation
in the Request (confirmed by the declaration of
compliance with the established requirements by
filling in and providing the form "Declaration of
the Participant of the procurement procedure on
compliance with the established requirements"as
part of the application for participation);
5. The absence of information about the
Participant of the procurement procedure in the
register of unscrupulous suppliers provided for in
Article 5 of Federal Law No. 223-FZ and (or) in
the register of unscrupulous suppliers provided
for by Federal Law No. 44-FZ (confirmed by the
declaration of compliance with the established
requirements by filling in and submitting the form
"Declaration of the Participant of the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
6. Absence at the time of the procurement of
court decisions that have entered into force and
have not been executed on the improper performance
by the Participant of the procurement procedure of
obligations under contracts (contracts) for the
supply of goods, performance of works, provision
of services of the same name to the purchased
goods, works, services (confirmed by the
declaration of compliance with the established
requirements by filling in and providing the form
"Declaration of the Participant of the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
7. The participant of the procurement procedure
is not a person whose place of registration, or
place of residence, or place of tax residence is a
state or territory included in the list of states
and territories approved by the Ministry of
Finance of the Russian Federation in accordance
with subparagraph 1 of paragraph 3 of Article 284
of the Tax Code of the Russian Federation
(confirmed by the declaration of compliance with
the established requirements by filling in and
providing the form "Declaration of the Participant
of the procurement procedure on compliance with
the established requirements"as part of the
application for participation);
8. Procurement participant - a legal entity that
has not been brought to administrative
responsibility for committing an administrative
offense under Article 19.28 of the Code of
Administrative Offenses of the Russian Federation
(illegal remuneration on behalf of a legal entity)
within two years prior to submitting an
application for participation in the procurement
(confirmed by declaring compliance with the
established requirements by filling in and
providing the form "Declaration of a Participant
in the procurement procedure on compliance with
the established requirements"as part of the
application for participation);
9. The Participant of the procurement procedure -
an individual or the head, members of a collegial
executive body, a person performing the functions
of a sole executive body, or the chief accountant
of a legal entity - a participant in the
procurement has no outstanding or not removed
criminal records for crimes in the field of
economics and (or) crimes provided for in Articles
289, 290, 291, 291.1 of the Criminal Code of the
Russian Federation, as well as non-application of
administrative punishment in the form of
disqualification and punishment in the form of
deprivation of the right to hold certain positions
or engage in certain activities related to the
supply of goods, performance of work, provision of
services to these individuals which are the object
of the ongoing procurement (confirmed by the
declaration of compliance with the established
requirements by filling in and providing the form
"Declaration of the Participant of the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
10. The absence of a conflict of interests
between the Participant of the procurement
procedure and the Customer, which means cases in
which the head of the customer, a member of the
expert group, a member of the procurement
commission, a person responsible for organizing
the procurement procedure, are married to
individuals who are beneficiaries, the sole
executive body of the business company (director,
general director, manager, president and others),
members of the collegial executive body of the
business company, the head (director, general
director) of an institution or unitary enterprise
or other management bodies of legal entities
participating in the procurement, with
individuals, including those registered as an
individual entrepreneur, - participants in the
purchase or are close relatives (relatives in a
direct ascending and descending line (parents and
children, grandparents and grandchildren), full -
and incomplete (having a common father or mother)
brothers and sisters), adoptive parents or adopted
children of these individuals (confirmed by the
declaration of compliance with the established
requirements by filling in and providing the form
"Declaration of a Participant in the procurement
procedure on compliance with the established
requirements"as part of the application for
participation);
11. The period of state registration of a
Participant in the procurement procedure before
submitting an application for participation in the
procurement procedure must be at least one
calendar year (12 months) (confirmed by
information from the Extract of the Unified State
Register of Legal Entities provided as part of the
application for participation);
12. The place of registration of the Participant
is the Krasnodar Territory, or the Participant
must have a separate representative office/ branch
in the Krasnodar Territory (confirmed by
information from the Extract of the Unified State
Register of Legal Entities provided as part of the
application for participation, or, if there is a
separate representative office/branch, a copy of
the notification of registration of a separate
representative office/ branch with the tax
authority);
13. The participant must necessarily travel to
the place of work before submitting an application
for participation in the procedure (confirmed by
the official letter of the Participant provided as
part of the application for participation
confirming the visit to the object);
14. The participant must have confirmed work
experience in the types of work specified in the
Terms of Reference for the last 2 (two) calendar
years before the date of publication of the
procurement procedure in the amount of at least
the contractual cost of the work (confirmed by the
completed form "Information on work experience"
provided as part of the application for
participation and certified copies of contracts
(contracts) with all appendices and acts of work
performed/services rendered, confirming the full
implementation of the contract);
15. The participant must confirm that the
customer agrees to withhold a guarantee deduction
in the amount of 5% of the amount payable by the
customer from all amounts payable for the work
performed under the contract until the signing of
the final act under the contract (the end of the
warranty period). (confirmed by the agreement with
the specified condition in the Application for
participation in the procurement procedure);
16. The participant must confirm the availability
of qualified labor resources for the timely and
high-quality fulfillment of obligations under the
contract (confirmed by filling out and providing
the form "Information about human resources" as
part of the application for participation, copies
of diplomas of higher education of specialists, an
extract from the staffing table).
The procurement procedure is an internal
procedure for selecting Suppliers by the Company
and should not be considered as a tender in the
sense of Articles 447-449 of the Civil Code of the
Russian Federation, and also is not a public
tender, which is regulated by Chapter 57 of the
Civil Code of the Russian Federation.
LLC Sanatorium Zapolyarye reserves the right at
any time to refuse to continue conducting this
Procurement procedure, to change the terms of its
conduct, as well as to refuse to conclude a
contract with a Supplier whose offer is recognized
as the best according to the results of the
procurement procedure.
At the same time, any costs associated with
participation in the procurement procedure are
borne by the participant independently, these
costs are not reimbursed by Zapolyarye Sanatorium
LLC under any circumstances.
