And also to prepare a technical and commercial proposal (hereinafter Technical and Commercial Proposal). The Technical and Commercial Proposal should be initialed on each page. The validity period of the Technical and Commercial Proposal must be at least 60 (sixty) calendar days.
At this stage, a request for proposals is being made in order to familiarize the Technical and Commercial Proposals of the Bidders, review and identify the most favorable conditions.
Next, the main price stage will be held (rebidding), to which Bidders who have submitted the most favorable offers will be admitted. As a result of rebidding, a decision is made on the expediency of concluding a supply contract.
This request for proposals procedure is not an offer, an invitation to make an offer, acceptance of an offer or an invitation to participate in a competitive bidding process, its conduct is not regulated by Articles 447-449 of the Civil Code of the Russian Federation. This procedure is also not a public tender and is not regulated by Articles 1057-1061 of Part two of the Civil Code of the Russian Federation.
The Customer is not obliged to conclude any transactions as a result of the request for proposals procedure, and has the right to refuse all received offers/bids for any reason or terminate the request for proposals procedure at any time without notifying the Call for Bid Bidders and does not bear any responsibility to the Bidders or third parties to whom such actions may cause losses.
The Customer also does not bear any obligation to reimburse Call for Bid Bidders or other third parties for any costs or other losses related to participation in the request for proposals procedure.
Thus, this request for proposals procedure does not provide for the fulfillment by the Customer of any civil obligations with respect to the Bidders of the Call for Bidding or to third parties.
