1. This competitive procedure upon the prior choice of the Supplier shall be directed in accordance with the Tender Rules of the Tender Organizer within the framework of the implementation of the Commercial Request Procedure proposals which (like the Provider's pre-selection procedure itself) is not an offer, auction or competition and its conduct is not governed by Art. 447-449 Part 1 and 1057-1061 Part 2 of the GK RF. Thus, this procedure does not impose an appropriate amount of civil obligations on the Organizer and reserves the right to refuse all the proposals received under any cause or terminate the selection procedure at any time without explanation, without incurring any responsibility to the Participants.$
2. The organizer of the tender reserves the right to select several winners by dividing the supply of the specified quantity of goods at its discretion and without explanation between several potential suppliers participating in the competitive procedure.$
3. Organization/documentation that does not conform to the requirements and forms specified in the notice, the Organizer has the right to reject without explanation and recognize this documentation and, accordingly, the Applicant does not to meet the requirements of this competitive procedure.
4. In the tender, I ask you to put the final prices, as well as to attach all the constituent documents according to the list in the attachment (Annex 1). Also indicate whether you are ready to accept our standard contract form without change.
5. Prices must be specified without VAT and include the cost of goods, packaging, documentation provided by legislation, delivery to the Factorates (Annex 2)
6. Payment will be made in rubles after the expiration of 60 (sixty) calendar days on the first payment day of the Customer (working Monday and Wednesday) after receiving the goods in the Buyer/Consignee's warehouse. If it is impossible to confirm the requested payment terms, please offer your own. Please note that any advance must be provided by the Bank Guarantee (not welcome). Standard penalties 2.5% per week. 7. Proposals during the procedure will be accepted for consideration provided that the price is fixed for a minimum of 4 months with possible prolongation (preference is given to the supplier with the highest price fixing period). The Organizer reserves the right not to consider proposals that do not meet the standard requirements of Rusagro. Suppliers who have confirmed Rusagro conditions during the tender, and subsequently do not hold fixed deadlines — can be added to the list of unreliable suppliers (in subsequent tenders will not be invited).
8. The winner (s) of the tender committee is approved by the chairman of the tender committee, based on the results of all aggregate factors (price, deferment of payment, availability /absence of advance, guarantee, standard Rusagro, timing of price fixing).
9. Delivery not one-time
10. In case of obtaining prices according to the results of the tender above the budget planned by the plants, it is possible to carry out overbidding between participants of the main stage.
11. Proposals of applicants whose companies have a registration period of less than one year and have not provided statutory and accounting documents for ETP shall not be accepted for consideration (Annex 1)
12. When signing contracts with the winning suppliers, it is mandatory to sign Appendix 5 "Anti-corruption Clause" and Appendix 6 "Special conditions_ due diligence" with two Parties (Supplier and Plant)
