1. This competitive procedure, upon prior selection of the supplier, is directed in accordance with the tender regulations of the tender organizer as part of the procedure for requesting commercial proposals, which (as well as the procedure itself Preliminary selection of the supplier) is not an offer, auction or competition and its holding is not regulated by art. 447-449 hours 1 and 1057-1061, 2 of the Civil Code of the Russian Federation. Thus, this procedure does not impose on the organizer the corresponding volume of civil obligations and reserves the right to refuse all received offers for any reason or to terminate the selection procedure at any time without Reasons without incurring any liability to the participants.
2. The tender organizer reserves the right to choose several winners, dividing the delivery of the specified quantity of goods at its discretion and without explanation of the reasons between several potential suppliers-participants of the competitive procedure.
3. Organization/documentation that does not conform to the requirements and forms specified in the notice, the organizer has the right to reject without explanation and to recognize this documentation, and, accordingly, the applicant, not conforming to the requirements of this Competitive procedure.
4. In the tender, I ask to put the final prices, as well as attach all the constituent documents according to the list in the attachment (Appendix 1). Also indicate whether you are ready to accept our standard contract form unchanged.
5. Prices should be specified without VAT and include the cost of goods, packaging, registration of the statutory documentation, delivery to the factories.
6. Payment will be made in rubles after the expiry of 35 (thirty-five) banking days on the first payment day of the customer (working Monday and Wednesday) after receiving the goods at the warehouse of the buyer/consignee. In case of impossibility to confirm the requested payment terms, we ask you to offer your own. Please note that any advance payment must be provided by the bank guarantee (not welcomed). Standard penalties 2.5% per week. (See contract template Annex 4).
7. The proposals in the course of the procedure will be accepted for consideration, provided that the price is fixed for a minimum of 4 months with a possible prolongation (preference is given to the supplier with the longest price fixing period). The Organizer reserves the right not to consider the proposals not conforming to the standard requirements of Rusagro. Suppliers who have confirmed the conditions of Rusagro during the tender, and subsequently do not hold the agreed terms of fixation, may be added to the list of unreliable suppliers (there will be no invitations to the subsequent tenders).
8. The winner (i) of the bidding is approved by the Chairman of the Tender Committee, according to the results of all cumulative factors (price, deferred payment, availability/absence of advance, guarantee, standard terms rusagro, terms of fixing the price).
9. Delivery... The quantity can be adjusted at the request of the plant both in the big and in the smaller party.
10. In case of receiving the prices on the results of the tender above the budget, planned by the factories, it is possible to conduct a flow between participants of the main stage.
11. Proposals of applicants whose companies have a registration period of less than one year and which have not provided statutory and accounting documents to the ETP are not accepted for consideration (appendix 1)
