This competitive procedure for the preliminary selection of a Supplier is directed in accordance with the Tender Regulations of the Tender Organizer as part of the request for commercial proposals procedure, which (like the Contractor's pre-selection procedure itself) is not an offer, auction or tender and its conduct is not regulated by Articles 447-449 Part 1 and 1057-1061 Part 2 of the Civil Code of the Russian Federation.
Thus, this procedure does not impose an appropriate amount of civil obligations on the Organizer and reserves the right to refuse all received Offers for any reason or to terminate the selection procedure at any time without explanation, without incurring any liability to the Bidders.
To participate in the tender, it is necessary to send through the E-Marketplace www.b2b-center.ru the next set of documents:
1. An official letter from a potential supplier (Bidder) about the absence of circumstances preventing participation in the tender, A COMPLETED BID FOR PARTICIPATION. Bid evaluation is not provided without this application.
2. The documents listed in the Bid for participation to this invitation (only those that have been updated after accreditation)
The validity period of your offer must be at least 180 (one hundred and eighty) days from the date of receipt of your offer. If an agreement is concluded with your company during the term of the offer, the term of your offer remains unchanged until the obligations under such an agreement are fulfilled.
1. The tender organizer reserves the right to select several winners, dividing them at its discretion and without explanation among several potential suppliers-Bidders of the competitive procedure.
2. An organization/documentation that does not comply with the requirements and forms specified in the Bid Notice may be rejected by the Organizer without explanation and recognized as this documentation, and, accordingly, the Applicant, does not comply with the requirements of this competitive procedure.
3. A visit to the facility to familiarize yourself with the scope of work is desirable (detailed in the Terms of Reference).
4. The conduct of the competitive procedure includes the competitive bidding process itself with the filling in of all additional fields of proposals. The selection of APPLICANTS is carried out according to the documentation provided. The offer must be uploaded before the Competitive bidding process end date.
5. Prices must be stated excluding VAT and include all Contractor's expenses for the performance of works and/or deliveries, and Supplier's remuneration.
6. Payment will be made in rubles, the standard deferral of payment after 60 (fifty) calendar days on the first payment day of the Customer (working Monday and Wednesday) after the completion of the work and the signing of the Acceptance and transfer Certificates. If it is impossible to confirm the requested payment terms, we ask you to offer your own. Please take into account that any advance must be secured by a Bank Guarantee (not welcome). The standard penalties are 2.5% per week.
7. The winner(s) of the competitive bidding process is approved by the Chairman of the tender committee, based on the results of all cumulative factors (price, deferred payment, availability /absence of advance payment, guarantee, standard terms of Rusagro, work deadlines, no obstacles to the execution of the contract, quality and completeness of the documentation provided).
8. All competitive bidding processes for Rusagro's counterparties on the B2B E-Marketplace are free of charge. E-Signature is not required at the moment.
9. Questions on the Terms of Reference - the Customer's representative, contacts are specified in the Terms of Reference, and/or the "Responsible Person" section of this Request for Proposals.
10. The presence at the testing of products in the RLS is carried out by prior agreement. If the Bidder of the procurement procedure wishes to attend the testing, he/she needs to send an official request to the Contact (responsible) person of this Request for Proposals through the E-Marketplace functionality and/or e-mail, indicating the purpose of the visit.

The Bidders of the tender, when drawing up and developing the proposal, are obliged to use the annexes listed above to this invitation and submit all the documents constituting the tender proposal in accordance with their requirements.
The tender Bidder's offer must not contain any conditions that contradict the requirements of the bidding documentation.
