This Request for Proposals procedure is not an auction, including a tender and/or auction, and its conduct is not regulated by Articles 447 – 449 of the Civil Code of the Russian Federation. This Request for Proposals procedure is also not a public tender and is not regulated by Articles 1057 – 1061 of the Civil Code of the Russian Federation. Thus, this procedure does not impose an appropriate amount of civil obligations on the Organizer and reserves the right to refuse all Proposals received for any reason or terminate the selection procedure at any time, without incurring any responsibility to the Participants.
The choice of Supplier will be determined taking into account the IDO (Due Diligence Index). When summing up the results of the procurement procedure, the Organizer, at its discretion, guided by internal regulatory documents, can make decisions regardless of the lowest price offer.
The conclusion of a contract with a potential Supplier (Seller) is considered only on the terms of the standard contract form of JSC "NZHS" (the contract form is attached).
By the decision of the Organizer, it is possible to summarize the results of the procurement procedure after providing samples of the subject of purchase and conducting laboratory tests. |
