This Request for Proposals procedure is not a competitive bidding process, including a tender and/or auction, and its conduct is not regulated by Articles 447-449 of the Civil Code of the Russian Federation. This Request for Proposals procedure is also not a public tender and is not regulated by Articles 1057-1061 of the Civil Code of the Russian Federation. Thus, this procedure does not impose an appropriate amount of civil obligations on the Organizer and reserves the right to refuse all received Offers for any reason or to terminate the selection procedure at any time, without incurring any liability to the Bidders.
The choice of Supplier will be determined taking into account the IDO (Due Diligence Index). When summarizing the results of the procurement procedure, the Organizer, at its discretion, guided by internal regulatory documents, may make decisions regardless of the offer of the lowest price.
The conclusion of an agreement with a potential Supplier (Seller) is considered only on the terms of the standard form of the agreement of JSC "NZHS" (the form of the agreement is attached).
By the decision of the Organizer, it is possible to summarize the results of the procurement procedure after providing samples of the Call for Bidding item and conducting laboratory tests. |
