Interim financing is made on a monthly basis based on the amount of work presented by the Subcontractor as of the last day of the reporting period. The reporting period is a calendar month.
Interim financing is carried out on the basis of documents signed by the Parties in the form KS-2, KS-3, presented in the reporting period, in the following order:
- 50% of the cost of construction and installation work specified in the KS-3 form approved by the Contractor, including 50% of the cost of materials supplied by the Contractor under the supply agreement, the Contractor pays no later than 15 (fifteen) working days from the date of signing by the Contractor of the KS forms -2, KS-3 for the reporting period and the Subcontractor submission of an invoice, invoice, drawn up in accordance with the requirements of the legislation of the Russian Federation. In the event that the Contractor pays an advance payment, the advance payment is offset in proportion to the volume of work performed in the reporting period;

At the same time, the Parties confirm that the amount of the reservation is a guarantee retention that performs a security function and is a way to ensure the fulfillment of the Subcontractor's obligations under the Agreement. The Contractor has the right to satisfy his claims against the Subcontractor through such withholding, including, but not limited to: a commensurate reduction in the price of work, reimbursement of expenses for eliminating deficiencies (including for warranty obligations), payment of fines and penalties.
