The procedure for settlements for the work performed:
Interim financing is made on a monthly basis based on the amount of work presented by the Subcontractor as of the last day of the reporting period. The reporting period is a calendar month.
Interim financing is carried out on the basis of documents signed by the Parties in the form KS-2 KS-3, presented in the reporting period, in the following order:
- 93% of the total cost of the work specified in the KS-3 form approved by the Contractor, the Contractor pays no later than 15 (fifteen) working days from the date the Contractor signs the KS-2, KS-3 forms for the reporting period and the Subcontractor submits an invoice, invoice issued in accordance with the requirements of the legislation of the Russian Federation.
- payment of 6.5% of the total cost of the work specified in the KS-3 form approved by the Contractor (hereinafter referred to as the "reservation amount"), the Contractor makes after 15 working days from the date of signing the Acceptance Certificate of the work performed under the work contract, transfer of all residential and non-residential premises that are part of the Object, the Customer's Customer Service Service, participants in shared construction, or other purchasers of premises and the operating organization ";
- payment of 0.5% of the total cost of work specified in the KS-3 form approved by the Contractor (hereinafter - the "guarantee amount"), the Contractor withholds until the expiration of the warranty period for the result of work under the Contract and pays within 10 banking days from the date the end of the specified warranty period.
The warranty period for the result of work, including all structural elements, materials used and everything else that constitutes the result of the work, is 5 years 6 months from the date of signing by the Parties of the Certificate of acceptance of the work performed under the contract. The parties acknowledge and understand that according to Part 5 of Art. 7 ФЗ dated December 30, 2004 No. 214-ФЗ "On participation in shared construction of apartment buildings and other real estate objects and on amendments to certain legislative acts of the Russian Federation", the warranty period is calculated from the date of transfer of the shared construction object to a participant in shared construction.
