Payment terms:3.3. The customer shall pay for the works carried out under this contract within 90 (ninety) calendar days after the signing of the Final Act on acceptance of the executed works (Form № KS-2) of the reference on the cost of work performed and costs (Form № KS-3) and Providing the invoice within the contract price of the facility, the set of executive documentation. Payment of executed and accepted works is made up to 95% of the cost of the executed works.
The obligations of the customer to pay the works are counter to the contractor's obligation to provide documentation, including the executive documentation (paragraphs 4.2.21 of this Agreement). If the contractor does not provide the documentation, including the executive documentation, the customer has the right not to pay the work until the contractor provides the above documentation in full. Payment of the work after submission of the documentation is carried out in the order and terms specified in this paragraph.
Payment of the remaining 5% of the cost of the executed works is made by the customer within 30 (thirty) calendar days after the signing by the customer and the contractor of the acts on elimination of defects, comments and shortcomings identified during the operation of the facility in Within 90 calendar days after the signing of the final acts of the executed works (KS-2).
