Upon completion of the application stage, the process of reviewing and adjusting the technical part of the TCH begins in order to achieve the parameters set in the TK.
After the approval of the TCH by both Parties, the price stage (rebidding) is carried out, to which the Participants will be admitted, whose TCH will be agreed on the technical part.
Based on the results of rebidding, a decision is made to select a Winner for the supply of equipment.
This request for proposals procedure is not an offer, an invitation to make an offer, an acceptance of an offer or an invitation to participate in an auction; its conduct is not regulated by Articles 447-449 of the Civil Code of the Russian Federation. This request for proposals procedure is also not a public tender and is not governed by Articles 1057-1061 of Part Two of the Civil Code of the Russian Federation.
The Customer is not obliged to conclude any transactions based on the results of the request for proposals procedure, has the right to refuse all received offers (bids) for any reason or terminate the request for proposals procedure at any time without notifying the Procurement Participants and does not bear any responsibility to the Participants or third parties to whom such actions may cause losses.
The customer also does not bear any obligations to reimburse the Purchasing Participants or other third parties for any costs or any losses associated with participation in the request for proposals procedure.
Thus, this request for proposals procedure does not provide for the fulfillment by the Customer of any civil obligations in relation to the Procurement Participants or third parties to whom such an action may cause losses.
The procurement participant, taking part in the request for proposals procedure, confirms that he is familiar with and agrees with these terms and conditions.
