4. Price and payment procedure.
4.1. Total cost of work. In addition, VAT is payable in the amount established by the current legislation.
4.2. Unit prices used to determine the total cost of work are fixed and cannot be revised due to changes in the volume of work actually performed.
4.3. The Parties agree that the total cost of work and the unit price are taken into account and include:
a) all the Contractor's own expenses, in particular the costs of transportation, packaging, relocation, accommodation, staff accommodation, communication, garbage collection, concrete chips, materials, copying services, warehousing, rental of equipment, purchase of consumables, equipment and equipment in accordance with the responsibility matrix.(Appendix To)
b) possible fluctuations in the exchange rate, if any or all of the materials and other resources used in the execution of this Contract are purchased by the Contractor outside the Russian Federation.
c) surcharges for harsh working conditions (dirt, sludge, chemicals, dust, elevated temperature, noise, altitude and similar conditions);
d) additional payment for overtime work, night work, work on Sundays and holidays;
e) special compensation, travel expenses, including allowances;
f) the cost of all necessary insurance.
g) remuneration of the Contractor for coordination of interaction with other contractors (subcontractors), which is not subject to separate payment.
h) other expenses necessary to fulfill the provisions of the Contract by the Contractor are included in the total cost of work and the unit price.
i) the cost of development of the project of production of works (PPR) and other organizational and technological documentation;
j) measurement geodetic works, including marking, executive surveys, schemes, etc., division of responsibility between the Customer and the Contractor in accordance with SNiP 3.01.03 – 84 Geodetic works in construction;
k) the costs of constructions and activities specified in the PPR;
l) expenses for the operation of used equipment, machinery, equipment;
m) the cost of mobilization/demobilization, arrangement and maintenance of a household town;
n) the costs of moving materials on the construction site from storage sites to work sites, as well as all loading and unloading activities ;
o) the cost of all loading and unloading operations, mechanisms, machinery, materials, equipment;
p) all costs of protective measures;
q) all costs for the production of works in winter.
4.6. The final settlement (post-payment) is carried out on the first payment day after 60 days from the date of the invoice in the presence of the act of acceptance of completed works signed without comments (in cases provided for by law, the unified form of COP-2 and a certificate in the form of COP-3 are used), executive documentation and the original invoice. If the date of the invoice is earlier than the date of signing by the parties of the acceptance certificate of the completed works without comments, the Customer has the right to increase the payment period by the number of days between these dates.
When paying for the work performed, the Customer pays in full, then makes a deduction (security payment), the remaining amount is subject to transfer to the Contractor.
4.7. Payment days are the 4th, 14th, 24th of each month. If the payment deadline falls on a non-working and (or) public holiday, the payment is made on the next working day.
At the same time, the period until the next payment day is not a period of late payment.
4.8. Payment for the work performed is made by the Customer in cashless form to the account specified by the Contractor in writing.
The Customer's obligation to pay is considered fulfilled from the date of debiting funds from the correspondent account of the Customer's bank.
4.9. Invoices must contain information about the Contract number, bank details for calculating the payment. The Customer has the right not to make payment until the Contractor provides the correct originals of the documents.
Comments: JSC "Mondi SLPC" reserves the right to change the deadline for the collection of technical and commercial proposals, cancel the collection of technical and commercial proposals, refuse all proposals, while applicants are not entitled to claim compensation for direct or indirect losses.
The decision on the choice of a counterparty for this request will be made after consideration of the submitted proposals.
Notification of the bidder about the results of the tender is provided in case of a positive result and a decision to conclude a contract, other participants can be provided only upon their written requests in order to motivate them to eliminate shortcomings or improve the attractiveness of their proposals.
Expenses related to the preparation and submission of technical and commercial proposals are not reimbursable.
