Restriction on submission of a bid higher than previously submitted
Bidding initiator has set a restriction on submission of a bid with a price which is higher than the price of the previous bid submitted by the bidder. Once the bid is submitted, the stated price can not be increased.

Minimum bid increment/decrement
The Organizer has established a minimum decrement for a Bidder's changing the total lot price from their previously submitted proposal.

Comments: 1. The present competitive procedure for the preliminary selection of the Supplier is sent in accordance with the Tender Regulations of the Tender Organizer as part of the procedure for requesting commercial proposals, which (like the Supplier's preliminary selection procedure itself) is not an offer, auction or competition and it is not regulated by art. 447-449 h. 1 and 1057-1061 h. 2 of the Civil Code. Thus, this procedure does not impose on the Organizer a corresponding amount of civil and legal obligations and reserves the right to refuse all received proposals for any reason or to terminate the selection procedure at any time without giving reasons without incurring any responsibility to Participants.
To participate in the tender, participants must be accredited to the specified ETP in accordance with the rules of this ETP for tenders of Rusagro
2. The organizer of the tender reserves the right to choose several winners by dividing the delivery of the specified quantity of goods at its discretion and without explanation of the reasons among several potential suppliers participating in the competitive procedure.
3. Template of a standard contract of the customer is attached to the tender documentation.
4. Half-closed KP or incomplete KP are not accepted by tender.
5. After the bidding process, the bidder’s bid price becomes fixed and cannot be increased.
6. Organization / documentation that does not meet the requirements and forms specified in the notice, the Organizer has the right to reject without giving reasons and recognize this documentation, and, accordingly, the Applicant that does not meet the requirements of this competitive procedure.
7. Winner (s) of bidding is approved by the chairman of the tender committee, based on the results of all aggregate factors (price, deferred payment, presence / absence of advance payment, guarantee, standard conditions of Rusagro)
