Payment terms:
Within 5 (five) days from the date of signing the protocol on the results of the Competitive Bidding Process, the bankruptcy trustee sends to the winner of the Competitive bidding Process an offer to conclude a lease agreement for the property/lot with the attachment of the draft agreement in accordance with the Competitive bidding process winner's offer on the price of the property/lot.
7.2. The mandatory terms of the contract concluded with the Winner are:
• information on the types of work, services, supplies, their composition, characteristics, description;
• contract price;
• other conditions stipulated by the legislation of the Russian Federation.
7.3. The Competitive Bidding process winner shall sign the contract within 5 (Five) days from the date of receipt of the tender manager's proposal to conclude the contract. In case of refusal or evasion of the winner of the COMPETITIVE BIDDING process from signing the said contract, the bankruptcy trustee is obliged to offer to conclude the contract to the Bidder who is offered the lowest lot price compared to the lot price offered by other Bidders, except for the winner of the Competitive bidding process.
7.4. In case of refusal or evasion of the competitive bidding process winner from signing the contract within 5 (five) days from the date of receipt of the proposal to sign the contract from the bankruptcy trustee, the bankruptcy trustee within 5 (five) days, shall propose to conclude the property/lot contract by sending a registered letter with a notification of delivery to the Bidder who offered the most a low lot price compared to the lot price offered by other Bidders, except for the Competitive Bidding process winner, at the price offered by this Bidder. If this Bidder refuses to conclude the contract or does not receive a response from him within 5 (five) days from the date the tender manager sends the proposal to conclude the contract, the organizer of the Competitive Bidding Process within 2 (two) days is obliged to recognize the Competitive bidding process as failed with the preparation of the relevant protocol, set a date for repeated competitive bidding process, transfer to the operator of the electronic platform the protocol on recognition of the competitive bidding process as invalid.
