Delivery terms:
Delivery is carried out by and at the expense of the Supplier. Goods and equipment must be packed into cargo spaces. One cargo place cannot contain different units. A packing list should be pasted on each cargo place. Inside each cargo place, an inventory must be enclosed on the goods that are located in this cargo place. The Supplier guarantees that the Product has not been in use before, is suitable for its intended use and complies with all applicable regulatory requirements for this kind of product. The Buyer undertakes to accept the Goods in terms of the number of cargo spaces (for compliance with the quantity agreed by the Parties in the Appendix) and in terms of quality (for the absence of obvious external damage to the packaging of the Goods). The supplier ensures strict compliance with the requirements for packaging and labeling of Goods established for cases of further transportation to the Far North; packaging must ensure the safety of cargo during its transportation, storage (accumulation) and cargo handling; cargo must meet the requirements of GOST 15846-2002 "Products shipped to the Far North and hard-to-reach areas. Packaging, labeling, transportation and storage." When goods are delivered in improper containers /packaging, the Supplier is responsible for the consequences of changes in the condition of the cargo caused by the process of transportation, storage and cargo handling, otherwise the Supplier's obligations are not considered fulfilled, claims for downtime of the Supplier's vehicles are not accepted, and the Buyer has the right, at his discretion, to refuse acceptance of Goods delivered with non-compliance with the above requirements, or to finalize the cargo (to carry out the necessary packaging, labeling) by their own efforts and means, with all incurred costs attributed to the Supplier by withholding them when transferring payment for the Goods.
The Supplier undertakes to provide the Buyer with packing lists by e-mail for checking their completion and approval before sending the cargo to the Buyer and/or transferring it to the Carrier. The Supplier undertakes by e-mail to provide the Buyer with photographs of the goods marked and assembled for transportation to the Buyer's address and documentation to it, before sending the cargo to the Buyer's address and/or transferring to the Carrier. The Supplier sends the documents specified in clause 1.3. of the Contract to the Buyer at the address: 677000, Republic of Sakha (Yakutia), Yakutsk, Dzerzhinskiy str., 27/2 (with a note for Evshina E.O.), no later than the date of shipment of the goods to the Buyer. Originals / copies, duly certified (the texts of the documents must be legible) passports for the entire list of goods and equipment, certificates of conformity, are provided together with the originals of invoices and waybills. The Buyer has the right to suspend the final settlement with the Supplier in case the latter fails to provide the original documents, including passports for the entire list of goods and services, certificates of conformity, invoices and waybills, by fax/e-mail to the Buyer., enclosing the originals together with the shipment.
Acceptance of Goods by the number of cargo spaces and the quality of their packaging is carried out by the Buyer in the Buyer's warehouse. Acceptance of Goods by quantity, assortment, completeness and quality is carried out by the final consignee of Sakhavolfram LLC at the place of operation within 40-60 days. Notify the Buyer of the arrival of the cargo at the destination 2 days before the execution.
